HMRC is often highly aggressive in defending its own interpretation of VAT law, and the law itself is often complex. This can make the process of disputing a VAT ruling or appealing a VAT assessment extremely stressful and worrying for clients.
We have very considerable experience of all aspects of VAT dispute resolution, from initial discussions with HMRC, through the Review process, and if necessary on to the Tax Tribunal. Our objective is always to secure a favourable outcome for our clients without recourse to the expense and uncertainty of litigation in the Tax Tribunal. However, sometimes litigation is unavoidable, and should that be the case, we have extensive experience in both managing and presenting appeals before the Tax Tribunal.
The Review procedure introduced in 2009 is a welcome addition to taxpayers’ rights, but the process itself has some potential pitfalls and has to be approached skilfully to avoid the prospect of HMRC simply rubber stamping their original decision.
