Why Tax Litigation is Different

Tax litigation has one great difference between most other litigation – in every case within the tax courts, HMRC is on the other side! 

This brings with it specific challenges for the tax litigator, which we relish.  The thirty or so cases handled in the last year included VAT, PAYE, Corporation tax, Abuse of Power by HMRC and CIS. 

In many VAT cases our clients are awarded costs and, whilst as rare as hens’ teeth, one client has also been awarded costs by the Special Commissioners having been satisfied by our case that HMRC had acted wholly reasonably. However, in every case, our intention is to reach settlement with HMRC without the need to cross the threshold of the tax courts.
